ACT — Debt Recovery Resources

The Australian Capital Territory has a compact but well-resourced civil dispute framework. The ACT Civil and Administrative Tribunal (ACAT) handles smaller civil disputes, while the ACT Magistrates Court has an unusually high civil jurisdictional limit compared with most other state magistrates courts. Access Canberra serves as the territory's consumer and business regulation body.

Merion operates in the ACT on a commission-only basis, recovering commercial debts in accordance with the ACCC/ASIC Debt Collection Guideline and ACT consumer law.

ACAT — ACT Civil and Administrative Tribunal

ACAT hears civil disputes including debt and consumer matters up to $25,000 (as at the date of this page — check the ACAT website for current monetary limits, as these may change). Proceedings are designed to be accessible without legal representation. ACAT also handles residential tenancy, discrimination, working with vulnerable people and a range of administrative review matters. The ACT's smaller population means ACAT is generally faster and more accessible than equivalent tribunals in larger states.

ACT Magistrates Court

The ACT Magistrates Court handles civil debt claims up to $250,000 — one of the highest civil jurisdictional limits among Australian magistrates courts (as at the date of this page — verify current limits at the court's website). This broad jurisdiction means that many commercial debt matters that would require a District or County Court in other states can be handled in the ACT Magistrates Court. For amounts above $250,000, matters proceed to the ACT Supreme Court.

Access Canberra

Access Canberra is the ACT Government agency responsible for delivering regulatory services, including consumer protection and business regulation. It administers the Australian Consumer Law in the ACT and can investigate complaints about misleading conduct, unfair contract terms and unconscionable conduct in consumer transactions. Access Canberra also provides licensing services for a range of occupations and industries operating in the territory.

Financial counselling in the ACT

Free financial counselling is available in the ACT through the National Debt Helpline and through Canberra-based community organisations. The ACT's compact size means face-to-face counselling is generally accessible to residents throughout the territory.
