NCAT — NSW Civil and Administrative Tribunal

NCAT is the primary small-claims and consumer dispute tribunal in New South Wales. Its Consumer and Commercial Division hears minor civil claims up to $20,000 (as at the date of this page — thresholds can change; check the NCAT website for current limits). Proceedings are designed to be accessible without legal representation. NCAT does not handle purely commercial debts between businesses unless a consumer law element is present.

NSW Local Court

The NSW Local Court handles civil debt claims up to $100,000. It is the most common venue for commercial debt enforcement in the state. Matters are decided by magistrates; parties may be legally represented. For debts above $100,000, matters proceed to the NSW District Court (up to $750,000) or the NSW Supreme Court. NSW Fair Trading

NSW Fair Trading is the state consumer protection agency operating under the NSW Department of Customer Service. It administers the Fair Trading Act 1987 (NSW) and can investigate complaints about misleading conduct, unfair contract terms and unconscionable conduct in consumer transactions. NSW Fair Trading also administers licence schemes for various industries and can mediate disputes before they escalate to a tribunal or court.
