Queensland has a four-tier civil court hierarchy. QCAT's Minor Civil Disputes jurisdiction provides an accessible, relatively informal process for smaller claims. The Magistrates Court handles the bulk of commercial debt enforcement. For larger matters, the District Court and Supreme Court of Queensland are available. All monetary thresholds noted below are subject to legislative change — always verify current limits at the relevant court's website before filing.

QCAT — Queensland Civil and Administrative Tribunal
QCAT's Minor Civil Disputes jurisdiction handles claims up to $25,000 (as at the date of this page). Legal representation is generally not permitted in Minor Civil Disputes except in limited circumstances. Applications can be lodged online through the QCAT website. Filing fees apply and vary by claim amount — check the QCAT website for current fees. QCAT also handles residential tenancy disputes, building disputes and a range of administrative review matters.

Queensland Magistrates Court
The Queensland Magistrates Court handles civil debt claims up to $150,000 (as at the date of this page). It is the primary venue for commercial debt enforcement in Queensland above the QCAT threshold. The court issues default judgments and enforcement orders including warrants to seize and sell property, redirection of earnings, and examination orders. Parties may be legally represented. The court sits in Brisbane and all major regional centres across Queensland.

District Court of Queensland
The District Court of Queensland handles civil debt claims between $150,000 and $750,000 (check the court's website for current limits). Proceedings are more formal than in the Magistrates Court; parties are generally legally represented. The District Court sits in Brisbane and major regional centres. Supreme Court of Queensland
The Supreme Court of Queensland has unlimited civil jurisdiction and handles debt claims above $750,000, complex commercial matters, statutory demands under the Corporations Act 2001, and winding-up applications. Federal Circuit and Family Court
Creditor petitions in personal bankruptcy are filed in the Federal Circuit and Family Court of Australia (FCFCOA). Corporate insolvency proceedings — including statutory demands and winding-up applications — proceed in the Federal Court or the Supreme Court of Queensland depending on the circumstances.
